In short, pkmn is a free fan game in beta. You must be 13 or older, bring your own legally obtained ROMs and follow the Code of Conduct. Things may break or change. We are not connected to Nintendo or The Pokémon Company. The full terms below are what count.
1. About these terms
pkmn is a free online game made by fans. One person runs it as a hobby. In these terms, "we" and "us" mean that person, and "pkmn" means the game, the desktop client, this website, the wiki and the servers behind them.
By making an account or playing, you agree to these terms, the Code of Conduct and the Privacy Policy. If you don't agree, please don't use pkmn.
2. Who can play
You must be at least 13 years old to make an account. If the law where you live sets a higher age for using online services without a parent's consent, you need that consent too.
One account belongs to one person. Keep your password to yourself. Don't share, sell or give away your account. You are responsible for what happens on it, so tell us at [email protected] if you think someone else got in.
3. Your game files
pkmn ships no Nintendo game data. The client reads the ROM files you provide, and you must have obtained them legally. Don't ask for ROMs, and don't share or link them, in the game or anywhere else we run.
Download the client only from our Depot. A copy from anywhere else may have been changed.
4. The beta
pkmn is in an invite-only beta. Expect bugs, downtime and changes. Features may change or go away, and we may have to reset characters, Pokémon or items to fix a problem. We will say so in the release notes when we do.
We can't promise that pkmn will always be online or that it will keep running. If we decide to shut it down, we will try to give players notice first.
5. Playing fair
The Code of Conduct is part of these terms. In short: be decent to other players, don't cheat, don't bot, and don't trade game items for real money.
If you break the rules, we may warn you, mute you, remove things you posted, take back items you got unfairly, or suspend or close your account. You can appeal by writing to [email protected].
6. What you post
You keep the rights to what you write or upload, like chat messages, names and bug reports. You give us permission to store it, show it to other players where the game does that, and use bug reports and their attachments to find and fix problems.
Don't post anything illegal, anything you don't have the right to share, or anything the Code of Conduct rules out. We may remove content that breaks these terms.
7. The software
You may install the client and use it to play pkmn for yourself, not for profit. Don't change the client or the traffic it sends to cheat or automate play, and don't try to get into accounts, servers or data that aren't yours.
If any part of the software is ever offered under its own licence, that licence covers that part.
8. Donations and the shop
The shop is not open yet. When it opens, these rules apply.
- Donations are voluntary, and pkmn stays free to play.
- The shop offers cosmetic and convenience items only. Nothing in it makes your Pokémon stronger in battle.
- You must be 18, or have a parent's or guardian's permission, to buy anything.
- Items are delivered to your account right away, so donations are not refundable, except where the law says otherwise.
- If you live in the EU or the UK, you normally have 14 days to cancel an online purchase. Because shop items arrive at once, checkout asks you to tick a box to confirm you want them right away. Ticking it means you give up those 14 days.
- A shop item is licensed to you for use in pkmn. You don't buy or own the item itself.
- If you reverse a payment with your bank or card provider (a chargeback), we may close the account.
- Shop items have no cash value. You can't sell them or swap them for real money, and they end if pkmn shuts down.
9. Pokémon and trademarks
pkmn is a fan project. It is not affiliated with, endorsed by or sponsored by Nintendo, Creatures Inc., GAME FREAK or The Pokémon Company. Pokémon and the related names are their trademarks.
If you own rights in something on pkmn and want it taken down, write to [email protected]. Say what the material is, where it appears, what right you hold, and how we can reach you.
10. No guarantees
The software and the game are provided as is, without warranties of any kind, as far as the law allows. We don't promise that pkmn is free of bugs, that it suits any purpose, or that your progress will never be lost.
11. Limits on our liability
As far as the law allows, we are not liable for indirect or consequential losses, or for lost data, progress or items. Our total liability to you for any claim is limited to what you paid us in the 12 months before it. Nothing here limits liability that the law does not let us limit.
12. Closing your account
You can stop playing at any time. To delete your account, write to [email protected] from the email address on it. The Privacy Policy says what we delete and what we keep.
We may close an account that breaks these terms. We may also close all accounts if pkmn shuts down.
13. Changes to these terms
We may update these terms. The new version will have a new date at the top of this page. If a change matters, we will tell you in the game or by email, and we may ask you to agree again before you keep playing.
14. Governing law
These terms are governed by the laws of the State of Ohio, United States. If you live somewhere that gives you consumer rights these terms can't take away, you keep them.
